JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 11-01-2019 The present application has been filed for transfer of MTS Case No. 294 of 2017 (Tabrez Gauhar vs. Nasreen Perween) from the court of Principal Judge, Family Court, Gaya to the court of Principal Judge, Family Court, Patna for trial and disposal.
Heard Mr. Md. Anis Akhtar, learned counsel appearing for the petitioner and Mr. Suraj Narain Yadav, learned counsel appearing for the opposite party.
Considering the fact that the petitioner Nasreen Parween at present resides at Patna and the opposite party presently resides at Giridih, and Patna is more convenient and is on direct train route from Giridih as admitted by learned counsel
Patna High Court MJC No.2399 of 2018(4) dt.11-01-2019 2/2 representing the opposite party, for the ends of justice it would be fit and proper if the case is transferred from the court of Principal Judge, Family Court, Gaya to the court of Principal Judge, Family Court, Patna.
Accordingly, this application is allowed. The Principal Judge, Family Court, Gaya is hereby directed to transmit the entire record of the case to the court of Principal Judge, Family Court, Patna within a period of fortnight from the date of receipt/production of a copy of this order.
The transferee court at Patna is directed to dispose of MTS Case No. 294 of 2017 on priority basis and in order to assist the court for early disposal of this case parties are directed to appear before the Principal Judge, Family Court, Patna on 11th February, 2019 for fixing date in this case for early disposal of the case.
