====================================================== CORAM: HONOURABLE MR. JUSTICE S. KUMAR ORAL ORDER 24-08-2018 Heard learned counsel for petitioner and learned counsel for the State.

Petitioner, who is in custody, seeks bail in connection with Sonepur P.S. Case No. 103 of 2018 registered for the offences punishable under Sections 392 and 395 of Indian Penal Code.

Informant has alleged that in the night of 12.02.2018 after loading paint in his vehicle he went to sleep thereafter two unidentified persons came there and tied the informant and miscreants took away the vehicle loaded with paint, mobile and cash of Rs. 2,500/- from his possession. It has been submitted on behalf of petitioner that he is innocent and except his own confessional statement before the police no incriminating material is against him. It has been

No.43312 of 2018(3) dt.24-08-2018 2/2 further submitted that nothing was recovered from the conscious possession of the petitioner and similarly place co-accused Uttam Kumar has been granted bail by a co-ordinate Bench of this Court in Cr. Misc. No. 44056 of 2018 vide order dated 20.07.2018.

Considering the aforesaid fact and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate 1st, Saran at Chapra in connection with Sonepur P.S.
