Petitioner, who is in custody, seeks bail in a case registered for the offences punishable under Sections 341, 323, 34, 302 of the Indian Penal Code.

Petitioner has earlier moved this Court for bail vide Cr. Misc. No. 49228 of 2018 which was rejected on 27.09.2018. Petitioner is in custody since 17.04.2018.

There is direct allegation against petitioner of inflicting lathi blow upon the informant, as a result of which he died during course of treatment. Considering the nature of allegation made against petitioner, I am not inclined to enlarge the petitioner on bail. Hence, the prayer for bail of the petitioner

Patna High Court CR. MISC. No.75154 of 2019(3) dt.29-01-2020 2/2 is hereby rejected.

Trial court is directed to expedite and conclude trial within a period of six months from the date of receipt/production of a copy of this order. However, if the trial is not concluded within six months, petitioner may renew his prayer for grant of bail.
