The petitioner seeks bail in connection with Chenri P.S. Case No. 191 of 2019, registered under Sections 420, 467, 468, 469 and 379 of the Indian Penal Code.

The accusation is that on 05.08.2019, on receiving secret information about presence of some persons at Automated Teller Machine (ATM) Booth/Kiosk for withdrawing the money by cloning ATM card, the informant, along with other police personnel, reach the Automated Teller Machine (ATM) Booth/Kiosk of Punjab National Bank, Chenari Road, Rohtas, where one person was seen coming out from the Automated Teller Machine (ATM) Booth/Kiosk, who succeeded to flee away, while other persons who tried to flee away by motorcycle was apprehended. On search, four ATM cards of Punjab National Bank, four ATM cards of State Bank of India, four ATM cards of Bank of India, three ATM cards of Canara Bank,

Patna High Court CR. MISC. No.76333 of 2019(2) dt.07-01-2020 2/2 two ATM cards of Gramin bank, two ATM cards of Union Bank of India and several other ATM cards of other Banks, in the name of different persons, recovered. On query, about keeping the different ATM cards, he did not reveal any satisfactory reply. Submission is that the petitioner is in custody since 06.08.2019 with false allegagtion.

Shri Yugal Kishore Verma, learned Senior Counsel, appearing for the petitioner, submits that while the petitioner is accused in three similar nature of cases, as detailed in paragraph 2, but, in all three cases the petitioner is on bail. Having regard to the facts and circumstances of the case, let the petitioner, above named be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each in connection with Chenri P.S. Case No. 191 of 2019 to the satisfaction of the Chief Judicial Magistrate, Rohtas at Sasaram.
