Petitioner seeks bail in Ganga Bridge P.S. Case No. 18 of 2018 registered for the offence punishable under Sections 302/34 of the Indian Penal Code and Section 27 of the Arms Act.

Informant is the brother of the deceased, who in his fardbeyan has stated that his deceased brother (Shahrukh Khan) was posted as Store Keeper in Afcon company and on 03.02.2018 as usual he at about 7 pm went to his duty and at about 9:00 pm he received information that unknown criminals have killed his brother by firearm. It has been further alleged that his brother was receiving threat calls from last four to five days and he raised suspicion against the employee of the

Patna High Court Cr.Misc. No.44968 of 2018(3) dt.27-08-2018 2/2 company of being involved in his murder.

It has been further submitted that the petitioner is innocent and has picked up one mobile which was thrown on the road and thereafter was using the said mobile and on the basis of CDR, he has been arrested by the police. It has been further submitted that the petitioner is not in any way related to the murder of the deceased. Petitioner is in custody since 24.03.2018.

Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali, Hajipur, in connection with Ganga Bridge P.S. Case No. 18 of 2018.
