The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 181, 193, 468, 471 and 120(B) of the Indian Penal Code. One Ramu Yadav had sworn false affidavit in Cr.Misc.No.36406 of 2013 and Cr.Misc.No.2084 of 2014 stating therein that Kailash Kumar, son of the present petitioner had not married with any other lady. On detection of the aforesaid false statement, enquiry was made by the learned Registrar General and during enquiry Ramu Yadav stated that on the instruction of this petitioner, he had made such statement. Patna High Court CR. MISC. No.85210 of 2019(2) dt.07-01-2020 2/2 General was of the view that false statement was made by Ramu Yadav and consequence of false statement was known to him, hence he has taken evasive plea.

On the basis of statement of Ramu Yadav, the petitioner has also been arrayed as accused in the case. Considering the entire facts, let the above named petitioner be released on anticipatory bail in the event of his arrest or surrender in the court below within a period of thirty days from the date of receipt of the order, on furnishing bail bond of Rs.20,000/- (twenty thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Patna in connection with Kotwali P.S.Case No.464 of 2017 arising out of G.R.No.6033 of 2017, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. as well as condition that the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
