In this case, the petitioners are apprehending their arrest in connection with Giriyak P.S. Case No. 315 of 2019 registered for offences under sections 363 and 366(A) of the Indian Penal Code.

In the present case, allegation has been made that co-accused Aditya Raj Paswan @ Vicky has taken away the daughter of the Informant for the purpose of marriage in connivance of the present petitioners. Later on, the victim girl, Mausam Kumari @ Baby has sent a written report addressing to the S.H.O., Katrisarai police station, Nalanda stating there in

Patna High Court CR. MISC. No.79181 of 2019(2) dt.18-12-2019 2/2 that she has entered into marriage with Aditya Raj Paswan and, having threat perception on her life, they have fled away. The petitioner no.1 is mother whereas petitioner no.2 is the sister of the boy.

Looking to the entire facts and circumstances of the case, let the petitioners, above named, in the event of their arrest or surrender before the court below within a period of four weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nalanda at Bihar Sharif in connection with Giriyak P.S. Case No. 315 of 2019, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. as also subject to condition that whenever the police will call the petitioners for investigation/interrogation, they will remain present and if they would not present themselves, the privilege of grant of anticipatory bail shall be deemed to have been canceled.
