JUSTICE VINOD KUMAR SINHA ORAL ORDER 18-12-2019 This application, for grant of anticipatory bail, arises out of Bhabhua P.S. Case No. 368 of 2019 , disclosing offences under Sections 304(B)/34 of the Indian Penal Code. Petitioenr happens to be husband of the deceased and case is of dowry death.
Submission of learned counsel for the petitioner is that during investigation witnesses have been examined and they have stated that the deceased was mentally unsound and she has consumed poison. Moreover, the petitioner was not present at his house at the time of occurrence as he resides in Gujarat and further no specific allegation has been attributed to him.

Having heard both sides, in view of the above facts,
Patna High Court CR. MISC. No.75577 of 2019(3) dt.18-12-2019 2/2 this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Kaimur at Bhabua, in connection with Bhabhua P.S. Case No. 368 of 2019, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
