2. The petitioner is apprehending his arrest in Complaint Case No. 1459 of 2023 registered under Section 498A of the Indian Penal Code.

3. It is a case of matrimonial dispute.

4. It has been submitted on behalf of the petitioner that according to oral compromise, the petitioner has deposited a bank draft in the court below which is to be delivered to the opposite party No. 2.

5. From perusal of the order dated 22-09-2025, it

Patna High Court CR. MISC. No.85406 of 2024(10) dt.25-11-2025 2/2 appears that the opposite party No. 2 had assured to withdraw the case, if the petitioner makes the payment of Rs. 50,000/-.

6. Considering the aforesaid facts and circumstances, let the petitioner, above named, in the event of arrest/surrender before the learned court below within a period of four weeks, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Banka in connection with Complaint Case No. 1459 of 2023, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure/482(2) of BNSS, 2023.

7. The opposite party No. 2 is directed to withdraw the case(s) and the learned court below is directed to hand over the said draft to the opposite party No. 2 after withdrawal of the case.
