The petitioner is apprehending his arrest in a case registered under Sections 406, 420, 468, 371, 341, 323, 504 and 506 of the Indian Penal Code.

Allegation is that the accused persons misappropriated the fund of Pradhan Mantri Awas Yojna from Siyawati Devi's account.

It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has falsely been implicated in the present case. The main allegation is against the co-accused Jai Kumar. So far the petitioner is concerned, he is the brother of Jai

Patna High Court CR. MISC. No.75491 of 2019(2) dt.26-11-2019 2/2 Kumar. There is nothing specific alleged against the petitioner. The petitioner has been made accused only for the reason that he happens to be the brother of co-accused Jai Kumar. On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, in the event of arrest/surrender before the learned court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Araria in connection with Raniganj P.S. case No.249 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
