ANJANA MISHRA ORAL ORDER 02-12-2019 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State. The petitioner apprehend their arrest in connection with Bishambharpur P.S. Case No. 134 of 2018 registered for the offence punishable under Sections 341/323/324/308/504/ 506/34 of the Indian Penal Code.
Learned counsel for the petitioners submits that only on the basis of suspicion, the present petitioners have been roped in, in connection with the present case. Learned counsel for the petitioner further submits that earlier the mother of petitioner No. 1 had lodged an FIR against the informant and his family members bearing Bishambharpur P.S. Case No. 135
Patna High Court CR. MISC. No.76259 of 2019(2) dt.02-12-2019 2/2 of 2018 and there is on-going land dispute between the parties and they have no criminal antecedents.
In view of the aforementioned facts and circumstances, let the petitioners above named be released on bail, in the event of their arrest or surrender before the court below within a period of four weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, X, Gopalganj in connection with Bishambharpur P.S. Case No. 134 of 2018, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C. (Anjana Mishra, J) Saif/- U T
