The petitioner has come before this Court against the notice issued to him by the respondent / Bank on 21.11.2018 under Section 13(2) of the SARFAESI Act, 2002.

The sole contention of the petitioner is that he wishes to liquidate the loan.

Patna High Court CWJC No.23865 of 2019(2) dt.03-12-2019 2/2 This Court finds that the petitioner would have been well advised to respond to the aforesaid notice by intimating the Bank that he is ready to settle the dispute and liquidate the loan.

Without responding the aforesaid notice in the manner in which it should have been, the petitioner has approached this Court which was not at all necessary. Under the aforesaid circumstances and after some arguments, Mr. Hansh Raj, learned Advocate for the petitioner seeks permission to withdraw this petition in order to enable the petitioner to approach the Bank and communicate his intention to settle the dispute and liquidate the loan.

The petition stands disposed off in terms of above.
