Petitioner, already in custody, seeks bail in connection with Narpatganj (Bathnaha) P.S. Case No.251 of 2018, registered under Sections 406, 420 and 467 of the Indian Penal Code.

Allegation in brief is that the petitioner went to the informant and others and said that he has been awarded contract for construction of water tank in the village in each house and has taken money from some of the villagers and it is alleged that for excavating the earth for construction, the informant was engaged as labourer and a cheque of Rs.15,000/- was given to him as a labour charge but the same got dishonoured and the

Patna High Court Cr.Misc. No.45598 of 2018(2) dt.30-07-2018 2/2 bank said that it was a forged cheque.

Learned counsel for the petitioner submits that the allegation is false and fabricated, a copy of the cheque is also annexed with the application, which is said to have been issued by the petitioner but clearly the name of the signatory is of Sunil Singh on the cheque and not by the petitioner and in any case the dispute is relating to payment of wages and the petitioner has no criminal antecedent.

Having considered the aforesaid facts and circumstances, petitioner Shubham Shyamal is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Araria in connection with Narpatganj (Bathnaha) P.S. Case No.251 of 2018.
