Petitioner apprehend his arrest in a case registered for the offence punishable under Sections 341, 323, 504, 506, 308, 354/34 of the Indian Penal Code.

Informant in her written complaint has alleged that on 06.05.2019 at about 4:00 pm while she was sweeping near the gate of her house FIR named accused including petitioner entered her house and when she raised alarm his cousin came and rescued her. It is further alleged that accused Tanveer Alam assaulted her by iron rod on her head and accused Tareekh Anwar assaulted on her leg and different parts of the body by

Patna High Court CR. MISC. No.84483 of 2019(2) dt.19-12-2019 2/2 lathi. Accused Md. Sajjan and Md. Wali also assaulted her as a result of which she sustained multiple injuries. It has been submitted on behalf of the petitioner that he is innocent and has been falsely implicated in this case due to previous animosity and dispute between the parties. There is civil and criminal litigation going on between the parties with respect to encroachment of public land made by the family members of Informant. The nature of injury sustained by Informant on her head is simple in nature as per injury which has been annexed as Annexure-5/1.

Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on anticipatory bail in the event of his/her arrest or surrender before the court below within a period of four weeks from today upon furnishing bail bond of Rs. 20,000/- with two sureties of the like amount each to the satisfaction of learned court below where the case is pending, in connection with Barauni P.S. Case No. 189 of 2019, subject to the conditions laid down under Section 438(2) of the Cr.P.C.
