2. In this case, the petitioner is seeking regular bail in connection with Madhepur P.S. Case No. 26 of 2023 for the offence punishable under Sections 143, 341, 323, 353, 307, 120(B), 504, 506 of the Indian Penal Code and 27 of the Arms Act.

3. As per allegation, the police reached near the Punjab National Bank, saw some persons on the motorcycle and when the 'Chowkidar' enquired, the allegation is that Sohan Kumar Nayak opened fire causing injury to the said 'Chowkidar' Heera Khan in his chest. Thereafter, the accused persons fled away.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated.

Patna High Court CR. MISC. No.85609 of 2024(4) dt.09-04-2025 2/2 The allegation of making the informant injured by fire shot is against co-accused, Sohan Kumar Nayak and not against the petitioner. Learned counsel has also submitted that co-accused, Sanjeet Mukhiya who is on similar footing has been granted bail by co-ordinate bench. The petitioner is a person of clean antecedent.

5. On the other hand, learned APP for the State opposes the prayer for bail of the petitioner.

Considering the above-mentioned facts and circumstances especially the clean antecedent of the petitioner, the petitioner, above-named be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-III, Jhanjharpur, Madhubani in connection with Madhepur P.S. Case No. 26 of 2023 corresponding to G.R. No. 234 of 2023, subject to the following condition that the petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.
