This application for regular bail arises out of Harnaut P.S. Case No. 348 of 2018, disclosing the offences under Sections 147, 148, 149, 302 of the Indian Penal Code and Section 27 of the Arms Act.

The petitioner is in custody since 29.7.2019. The father of the deceased is the informant who named persons who had allegedly caused the occurrence, on the basis of information which he had gathered from the persons, whose identities were not disclosed in the First Information Report. In course of investigation, name of one Shashi Paswan surfaced as the person who had committed the offence and he was arrested. He

Patna High Court CR. MISC. No.78525 of 2019(2) dt.10-01-2020 2/2 is said to have confessed his guilt before the Police and disclosed the name of this petitioner as his accomplice. Learned counsel appearing on behalf of the petitioner has submitted that the said Shashi Paswan has been allowed regular bail by this Court by an order dated 29.04.2019 passed in Cr. Misc. 27830 of 2019. Since the co-accused Shashi Paswan has been allowed regular bail and the petitioner's name has surfaced on the disclosure made by him, this application is allowed.

Considering the facts and circumstances of the case, let the petitioner, above-named, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand), with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nalanda at Biharsharif, in connection with Harnaut P.S. Case No. 348 of 2018, subject to the condition that the petitioner shall present himself before the Police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the court on two consecutive occasions, his bail Bonds shall be liable to be cancelled.
