2. The petitioner apprehends his arrest in a case registered for the offence under Sections 406, 420, 467, 468, 471, 120(B) of the Indian Penal Code.

3. The prosecution case, in brief, is that the petitioner, who was posted as Branch Manager of Utkarsh Small Finance Bank Limited, Mashrakh, Saran, abused his official position by diverting loan amounts of its customers and misappropriated total amount of Rs. 7.67 Lakhs.

4. Learned counsel for the petitioner submits that petitioner is innocent and has committed no offence. Petitioner

Patna High Court CR. MISC. No.82182 of 2025(7) dt.06-07-2026 2/3 has not misappropriated even single penny and has been made escape-goat by the bank. However, learned counsel for the petitioner undertakes that petitioner is ready to refund the alleged amount to the bank in easy installments.

5. In the facts and circumstances of this case, the prayer for bail of petitioner is allowed. In the event of arrest/surrender within a period of eight weeks from today, let the above named petitioner be enlarged on provisional bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. - 7, Saran at Chapra in connection with Mashrak P.S. Case No. 377 of 2019, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure /Section 482 of the B.N.S.S. with further following conditions: "(A) At the time of furnishing bail-bond, the petitioner shall refund Rs. 2,50,000/- (Two Lakhs & Fifty Thousand) through Bank Draft to the Utkarsh Small Finance Bank Limited, Mashrakh, Saran.

(B) Rest amount i.e. Rs. 5,17,000/- (Five lakhs & Seventeen Thousand) shall be refunded to the Utkarsh Small Finance Bank Limited, Mashrakh, Saran through Bank Draft in 6 (six) installments within a period of twelve months from the date of furnishing bail-bond.

(C) If petitioner fails to comply the direction of

6. The learned Court concerned shall confirm the provisional bail of the petitioner after being satisfied that petitioner has complied the order of this Court and has refunded the alleged amount to the Utkarsh Small Finance Bank Limited, Mashrakh, Saran, as per direction of this Court.
