JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 31-01-2020 Heard learned counsel for the petitioner and learned learned Additional Public Prosecutor for the State. The petitioner is in custody in connection with Bidupur P.S. Case No. 20 of 2019 for the offenses under Sections 341, 323, 307, 504, 506, 448/34 of the Indian Penal Code.
Learned counsel for the petitioner submits that no fire arm injury was caused by the petitioner.
In the instant case, case diary was called for which has been received and from perusal of the same, it transpires that allegation levelled against the petitioner is not supported by the materials available in the case diary.
Considering the aforesaid, the Court is inclined to grant bail to the petitioner. Let the petitioner, above named, be
Patna High Court CR. MISC. No.81273 of 2019(4) dt.31-01-2020 2/2 enlarged on bail on furnishing bail bond of Rs. 25,000/-(Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Vaishali at Hajipur in connection with Bidupur P.S. Case No. 20 of 2019, subject to condition that the Court below shall verify the record on the point of injury and if it is found that there was no fire arm injury caused by the petitioner, the petitioner shall be released, otherwise, the Court below may refuse to release the petitioner on bail.
