JUSTICE VINOD KUMAR SINHA ORAL ORDER 20-01-2020 This is an application for grant of anticipatory bail in connection with Parasi P.S. Case No. 45 of 2019, disclosing offences under Sections 406 and 420 of IPC.

As per F.I.R. petitioner happens to be the Chairman of the PACS and there is allegation of defalcation/misappropriation of Rs.8,20,000/-.

Submission of learned counsel for the petitioner is that he is ready to pay the amount in installments, if some reasonable time is granted to the petitioner. Heard learned counsel for the B.S.F.C. also.

Having heard both sides, in view of the submissions of learned counsel for the petitioner, let the petitioner, above

Patna High Court CR. MISC. No.78236 of 2019(2) dt.20-01-2020 2/2 named, surrender within a period of six weeks from the date of receipt of certified copy of this order with a bank draft of Rs.1,20,000/- payable to the B.S.F.C., Arwal and on that, petitioner shall be released on provisional bail for a period of seven months. During that period, he has to pay the rest of the amount in seven equal installments of Rs.1,00,000/- by bank draft payable to the B.S.F.C., Arwal. Once the total amount is deposited, the provisional bail granted to the petitioner shall be confirmed.

It is also made clear that on failure to deposit two installments continuously, his bail bonds shall be cancelled. With the aforesaid, this application is disposed of. (Vinod Kumar Sinha, J) Sunil Shukla/- U T
