The petitioner seeks bail in connection with Tandwa P.S. Case No. 17 of 2010 dated 03.05.2010 instituted for the offence under Sections 147, 148, 149, 341, 323, 307, 353, 379 and 302 of the Indian Penal Code and Section 27 of the Arms Act and Section 17 of the CLA Act.

In an occurrence which led the loss of lives of several constables, the petitioner has been made accused.

It has been submitted that the accusation against the petitioner is only on the basis of suspicion as he is not named in the FIR. It appears that in an attack by extremists, some constables and police personnels

The petitioner has several cases of similar nature to his credit but learned counsel for the petitioner submits that in other cases also, his implication is only on the basis of suspicion. Except for one pending case, the petitioner is said to be on bail in all other cases. In the present case, many persons with similar allegation viz. of their being named during the course of investigation have been granted bail by different benches of this Court, some of the copies of such bail orders have been annexed with the petition.

The petitioner is said to be in custody since 04.09.2018.

Regard being had to the aforesaid facts, the petitioner above named is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Aurangabad in connection with Tandwa P.S. Case No. 17 of 2010.
