JUSTICE SANDEEP KUMAR ORAL ORDER 01-02-2024 Re.: Interlocutory Application No. 01 of 2021 The present interlocutory application has been filed for substitution of heirs and legal representatives of sole petitioner who died during the pendency of the present application.

2. For the reasons mentioned in the interlocutory application, it is allowed. Let the heirs and legal representatives of the sole petitioner as mentioned in paragraph 2 thereof, be substituted in his place and the name of the sole petitioner be expunged from the array of the parties.

3. Heard the parties.

4. The petitioner, as per the demand of the State, has deposited the cost of Rs. 68,000/- for deputation of the police force for assistance in erecting boundary wall by the petitioner. Despite such deposit, the police assistance has not been provided to the petitioner.

5. This application is being disposed of with a direction to the District Magistrate, Samastipur and the Superintendent of Police, Samastipur that they will see to it that the police force is deputed so that the boundary wall of the petitioner is constructed without any disturbance.

6. If any miscreant opposes these erection of the boundary wall, then the authorities will initiate action against him/them, in accordance with law.

7. Let a copy of this order be communicated to the District Magistrate, Samastipur and the Superintendent of Police, Samastipur for its compliance through FAX or e-mail forthwith.
