Petitioner seeks bail in Hisua P.S.Case No.293 of 2017 registered for the offences under Sections 414 of the I.P.C. and Section 25(1-b)a, 26 and 35 of Arms Act.

Allegation against the petitioner is that acting upon a tip of information the police raided the place of occurrence and arrested the petitioner and one motor cycle and one country made loaded pistol were recovered from his possession. Submission of the learned counsel for the petitioner is that he is in custody since 20.12.2017. One co-accused having similar allegation has been granted bail by a coordinate Bench of this Court vide order dated 18.08.2018 passed in Cr.Misc. No.35984 of 2018.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.25,000/- with two sureties of the like amount each to the satisfaction of C.J.M., Nawada, in Hisua P.S. Case No.293 of 2017 subject to the conditions and (1) one of the bailors must be a local person having sufficient immovable property within the jurisdiction of the concerned court. (ii) the petitioner will not induce any witness or tamper with the evidence and the petitioner shall co-operate in the disposal of the trial and make himself available as and when required by the court, otherwise, his bail bon shall be cancelled.
