The petitioner seeks regular bail in connection with Sahrasa Sadar P.S.Case No. 57 of 2019, registered for the offence punishable under Sections 406, 420, 467, 468, 384, 504 and 506/34 of the Indian Penal Code.

The allegation is regarding the petitioner having illegally sold the land of the informant by means of a registered sale deed. It is further alleged that the petitioner is claiming to be the owner of the land which belongs to the informant.

The learned counsel for the petitioner submits that the land disputes are pending in between the petitioner and the informant before the learned SDM, Saharsa and on

No.82086 of 2019(3) dt.20-12-2019 2/2 account of the said land dispute, the petitioner has been falsely implicated in the present case whereas the fact is that the land in question belongs to the petitioner and is his ancestral land. The petitioner is stated to be an accused in one other case, but he is on bail in the said case. The petitioner is stated to be languishing in custody since 21.8.2019. Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioner on regular bail.

Accordingly, the above named petitioner is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saharsa in connection with Saharsa Sadar P.S.
