2. The petitioner is in custody in connection with Tetarhaat P.S. Case No. 137 of 2025 for the offence punishable under sections 96 of the BNS.

3. As per the prosecution story, the informant alleged that his daughter had gone to the market but failed to return and upon search, it came to notice that the petitioner's son, Sanoj Ravi Daas has taken her away with the active connivance of the family members, when he contacted this petitioner, was threatened with dire consequences. This led to the FIR.

4. Learned counsel for the petitioner submits that the victim girl was in relationship with the petitioner's son, they left on their own, a perusal of the learned Sessions Judge order

Patna High Court CR. MISC. No.81747 of 2025(2) dt.03-12-2025 2/3 would show that she in her statement under Section 183 of the BNSS made a statement that she has married Sanoj voluntarily. The last submission is that the petitioner is in custody since 06.07.2025.

5. Learned APP opposes the prayer for bail submitting that the petitioner is also connived in the said disappearance of the victim girl.

6. Considering the submissions of the parties as also the materials on record including the statement of the victim girl as recorded in learned Sessions Judge order, petitioner is the father, in custody since 06.07.2025, in that background, this Court is inclined to extend him the privilege of bail with conditions.

7. Let the petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of like amount each to the satisfaction of learned Court of CJM, Lakhisarai in connection with Tetarhaat P.S. Case No. 137 of 2025 subject to the following conditions:

(i) one of the bailor should be the family member/relative of the petitioner who shall provide official document to show his/her bona fide;

(ii) the petitioner shall appear on each and every date

Patna High Court CR. MISC. No.81747 of 2025(2) dt.03-12-2025 3/3 before the Trial Court and failure to do so for two consecutive dates without plausible reason will entail cancellation of his bail bond by the Trial Court itself;

(iii) the petitioner shall in no way try to induce or promise or threat the witnesses or tamper with the evidences, failing which the State shall be at liberty to take steps for cancellation of the bail bonds;

(iv) the petitioner shall desist from committing any criminal offence again, failing which the State shall be at liberty to take steps for cancellation of his bail bonds. (Rajiv Roy, J) Vijay Singh/- U T
