Mr.Nand Kumar ====================================================== CORAM: HONOURABLE JUSTICE SMT. SONI SHRIVASTAVA ORAL ORDER 10-07-2025 Heard learned counsel for the petitioner, learned APP for the State and learned counsel for the opposite party no. 2.

2. The petitioner apprehends his arrest in a case registered for the offence punishable under Sections 341, 323, 498A, 504, 506, 34 of the Indian Penal Code and Section 3/4 of the Dowry Prohibition Act. .

3. By an earlier order, the matter had been sent to the Patna High Court Mediation and Conciliation Centre for resolution of disputes between the parties but the same has also failed.

4. Allegation in the first information report is with regard to the fact that the petitioner has an illicit relationship

Patna High Court CR. MISC. No.85537 of 2024(3) dt.10-07-2025 2/3 with his sister-in-law (Bhabhi) and is also demanding a car as dowry.

5. Learned counsel for the petitioner submits that the petitioner is ready to keep his wife with full dignity and honour.

6. Learned counsel for the opposite party no. 2 also makes a submission that the wife is ready to stay with her husband if he keeps her properly.

7. In such view of the matter, let the above named petitioner, be released on provisional bail for a period of four weeks, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Gogari (Gogri) P.S. Case No. 393 of 2023, subject to the condition as laid down under Section 438

(2) of the Cr.P.C./482(2) of the B.N.S.S.

8. The petitioner and the opposite party no. 2 would appear before the learned court below on 24.07.2025 and the petitioner would take his wife along with him from the Court premises itself. After the same has been done, the bail bonds on

Patna High Court CR. MISC. No.85537 of 2024(3) dt.10-07-2025 3/3 behalf of the petitioner would be accepted.

9. The learned court concerned would again keep a date to ensure that the husband and wife are leading a peaceful conjugal life and in such condition would confirm the provisional bail granted to the petitioner.
