JUSTICE VINOD KUMAR SINHA ORAL ORDER 20-01-2020 Petitioner seeks bail in anticipation of his arrest in connection with Sangrampur P.S. Case No. 159 of 2019 registered for the offences punishable under Sections 30(a), 35, 38 and 37(b) of Bihar Prohibition and Excise Act. There is recovery of 10 litres of liquor from the house of the petitioner.

Submission of learned counsel for the petitioner is that he has falsely been implicated and he has no criminal antecedent with respect to such type of cases earlier. Heard learned APP, who has opposed the prayer for anticipatory bail on the ground that recovery of liquor has been made from his house.

In view of above facts and circumstances, this

No.76987 of 2019(2) dt.20-01-2020 2/2 application is disposed of with direction to the petitioner to surrender and pray for regular bail, which shall be considered on its own merit, without being prejudiced by this order and, if possible, to be disposed of on the same day.
