JUSTICE AHSANUDDIN AMANULLAH ORAL JUDGMENT Date : 06-10-2020 The matter has been heard via video conferencing due to circumstances prevailing on account of the COVID-19 pandemic.
2. Heard Mr. Mithilesh Kumar Upadhyay, learned counsel for the petitioner and Mr. Sajid Salim Khan, learned SC 25 along with Mr. Wasi Ahmad Khan, learned AC to SC 25 for the State.
3. Pursuant to the earlier order, 4th supplementary counter affidavit has been filed on behalf of respondents no. 2 and 3.
4. Having regard to the issue involved and the latest affidavit of the authorities bringing on record order dated
Patna High Court CWJC No.14017 of 2018 dt.06-10-2020 2/2 01.10.2020 of the District Magistrate, Purnea directing for payment of full salary and other emoluments to the petitioner for the suspension period, the Court finds that nothing further remains in the present writ application.
5. Learned counsel for the petitioner fairly submitted that the grievances have been redressed. However, he prayed that the Court may indicate a time frame for actual payment of whatever has been ordered by the authorities, to the petitioner.
6. On this issue, learned counsel for the State submitted that allotment has been sought and, thus, to be on the safer side, four weeks' time be given for making the payment.
7. Having regard to the aforesaid, the Court would be practical in granting time.
8. Accordingly, the writ application stands disposed off directing the respondents to ensure that actual payment in terms of the orders passed by the authorities themselves be made to the petitioner positively within six weeks from today. (Ahsanuddin Amanullah, J.) P. Kumar/Anand Kr.
