2. The petitioner seeks bail in connection with Krishnagarh P.S. Case No. 52 of 2024 registered for the offence under Sections 302 and 34 of the Indian Penal Code.

3. As per the prosecution case, the allegation against the petitioner, who is the husband of the deceased, is of killing the deceased for demand of dowry.

4. Learned counsel for the petitioner has submitted that the deceased has committed suicide. He further submits that though, the place of occurrence has not been properly described by the I.O. of the case but the independent witness in this case

Patna High Court CR. MISC. No.1935 of 2025(3) dt.09-04-2025 2/3 has said that the deceased had committed suicide and the door of her room was opened after breaking the same by Khanti.

5. Learned counsel for the petitioner has further relied upon the ticket issued by the PMCH, Patna to argue that in the year 2015, the deceased has also tried to commit suicide by taking poison. The deceased and the petitioner were also having a son who is presently staying with the family of the petitioner.

6. The petitioner is in custody since 8.7.2024.

7. Learned APP for the State and learned counsel for the informant have vehemently opposed the application of the petitioner for grant of bail.

8. Considering the aforesaid facts, this application is allowed.

9. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bhojpur/concerned Court below in connection with Krishnagarh P.S. Case No. 52 of 2024.

10. As a condition of this order, the petitioner, after being released on bail is directed to co-operate in the trial either by appearing personally or through his lawyer in the trial Court

Patna High Court CR. MISC. No.1935 of 2025(3) dt.09-04-2025 3/3 on each and every date fixed by the trial Court. Non-compliance of the condition will result in cancellation of the bail bonds of the petitioner.
