The petitioner seeks regular bail in connection with Sadar PS case no. 226 of 2018 instituted for the offences punishable under Section 30(a) of Bihar Prohibition & Excise Act.

The allegation is regarding recovery of 1409.730 liters of illicit liquor from a room situated in a vacant land and the petitioner is stated to have been fled away from the spot after seeing the police party and was subsequently, apprehended. The learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case. It is further submitted that the petitioner is an accused in

The learned counsel for the petitioner, referring to para 9 of the present petition, has stated that the vacant land, where the room is situated, from where the illicit liquor has been recovered, does not belong to the petitioner. The petitioner is said to be languishing in custody since 18.10.2019.

Having regard to the facts and circumstances of the case, the abovenamed petitioner is directed to be released on regular bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-II-cumSpecial Judge (Excise), Darbhanga in connection with G.O. PS case no. 552 of 2018.
