1. Heard learned counsel for the petitioner and learned APP for the State.

2. The learned counsel for the petitioner submits that all the charge-sheet witnesses have been examined. It is submitted that after the examination of the charge-sheet witnesses were over, the prosecution again filed an application seeking to examine six more witnesses. It is further submitted that the said application was allowed and six months after the application being allowed, three witnesses have been examined, as such, three more prosecution witnesses still remain to be examined. It is further submitted that petitioner is in custody for nearly four years on account of land dispute which led to murder. It is also submitted that the physical condition of the

3. After making the said submission, the learned counsel for the petitioner seeks permission to withdraw the instant modification application with liberty to move before an appropriate forum in accordance with law.

4. Be that as it may, the modification application is permitted to be withdrawn.
