2. Petitioner apprehends their arrest in a case registered for the offence punishable under sections 467, 468 , 471 , 420 and 120(B) of the Indian Penal Code . 3 . As per the prosecution case , petitioner got appointed on the post of Panchayat Teacher on the basis of forged and fabricated educational certificates.

4. It is submitted on behalf of the petitioner that at the time of appointment, after thorough verification and scrutiny of the educational certificates, petitioner was appointed on the post of Panchayat teacher and behind the back without any notice, the same has been declared forged and fabricated. Moreover, petitioner has already been terminated from the post of Panchayat Teacher. Petitioner claims clean antecedent.

Learned counsel for the Vigilance opposed the bail petition and submitted that during investigation Bihar Sanskrit Shiksha Board, Patna vide letter no. 490 dated 07.11.2022 has informed that the self attested Madhyama marks sheet and certificate submitted by the petitioner has not been issued by Bihar Sanskrit Shiksha Board, Patna and is fake and fabricated. 6 Considering the contention made on behalf of the petitioner that during pendency of the case petitioner has already been terminated from service , clean antecedent of the petitioner and other circumstances of the case , in the event of arrest or surrender within eight weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.

10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate East Champaran at Motihari in connection with Banjariya P.S. Case No. 173 of 2024 , subject to the conditions laid down under section 482(2) of the Bharatiya Nagarik Suraksha Sanhita , 2023 .
