JUSTICE PRABHAT KUMAR JHA ORAL ORDER 28-11-2018 Heard the learned counsel for the petitioner, the learned counsel appearing on behalf of Motihari Nagar Parishad and the learned counsel for the respondents no.1 to 4. This MJC has been filed for initiation of the contempt proceeding against the opposite parties for violating the order dated 01.05.2018 passed in CWJC No.4062 of 2018. The learned counsel for the petitioner submits that the respondent no.3 was restrained from allotting the work to other tenderers who offered less amount but work was allotted in spite of the order passed by this Court. On such the learned counsel for Motihari Nagar Parishad submits that the work was allotted
Patna High Court MJC No.2630 of 2018(6) dt.28-11-2018 2/2 to the private respondent much before the interim order was passed by this Court.
Having considered the facts that before passing of the order dated 01.05.2018, the work was allotted to the private respondent, who offered Rs.7,51,000/-, I find that no case for initiation of contempt proceeding against the opposite parties is made out.
