Heard learned counsel for the petitioners and learned counsel for the State via video conferencing. The petitioners have filed the present application for grant of pre-arrest bail in connection with Kotwa P.S. Case No. 198 of 2019 registered for the offence punishable under Sections 341, 323, 307, 504 and 506/34 of the Indian Penal Code. Regard being had to the fact that though the occurrence is alleged to have taken place on 06.08.2019 at 05:00 PM and the police station is hardly two kilometers away from

Patna High Court CR. MISC. No.75710 of 2019(6) dt.17-06-2020 2/2 the place of occurrence but, the FIR was lodged on 07.08.2019 at 03:45 pm. and there is no plausible explanation for the inordinate delay caused in the FIR as also that the injury report of the injured is not available in the diary, petitioners are directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-X, East Champaran, Motihari in connection with Kotwa P.S. Case No. 198 of 2019, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
