Petitioner seeks bail in Chiraiya (Shikarganj) P.S.Case No.122 of 2018 registered for the offences under Sections 147, 149, 323, 341, 325, 307, 379, 504, 506 of the I.P.C. Allegation against the petitioner is of assault by lathi and also snatching Rs.60,000/- from the pocket of the informant. Submission of the learned counsel for the petitioner is that he is in custody since 17.6.2018 having no criminal antecedent and other co-accused Naveen Kumar having similarly situated along with two other co-accused have already been granted anticipatory bail vide order dated 5.6.2018 passed in Cr.Misc.No.51129/2018 by this Court Heard learned A.P.P. also.

No.47551 of 2018 (3) dt.20-09-2018 2/2 Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.25,000/- with two sureties of the like amount each to the satisfaction of C.J.M., Motihari E. Champaran, in Chiraiya (Shikarganj) P.S. Case No.122 of 2018 subject to the conditions that (1) one of the bailors must be a local person having sufficient immovable property within the jurisdiction of the concerned court. (ii) the petitioner will not induce any witness or tamper with the evidence and the petitioner shall co-operate in disposal of the trial and make himself available as and when required by the court, otherwise, his bail bond shall be cancelled.
