Petitioners are apprehending their arrest in Madhepur P.S.Case No.36 of 2014 corresponding to G.R.No.315 of 2014 registered for the offences under Sections 147, 148, 149, 341, 323, 324, 307, 302 of I.P.C.and Section 27 of Arms Act. Allegation against the petitioners is of assault and the petitioners were named in the F.I.R.

Submission of the learned counsel for the petitioners is that though the petitioners were named in the F.I.R., the police did not find the case true against the petitioners and other co-accused and they were not sent up for trial. But later on one of the accused persons who was summoned has already been granted privilege of anticipatory bail by a coordinate Bench of this Court vide order

Patna High Court Cr.Misc. No.46765 of 2018 (2) dt.13-08-2018 2/2 dated 28.6.2018 passed in Cr.Misc.No.35233 of 2018. Heard learned A.P.P. also assisted by the informant. Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioners, above named, surrender before the learned court below and pray for regular bail which will be considered by the trial court taking into consideration that final form was submitted and the petitioners were not sent up for trial and one of the accused persons, namely, Ghanshyam Yadav against whom summon was issued, has been granted privilege of anticipatory bail, if possible, on the same day on its own merit without being prejudiced by this order. With the aforesaid observation this application is disposed of.
