2. Petitioner seeks regular bail in connection with Noorsarai P. S. Case No. 524 of 2024 in a case registered for the offences punishable under Sections 191(2), 190, 115(2), 117(2), 103(2) of the Bharatiya Nyaya Sanhita.
3. It is alleged that this petitioner along with other accused persons assaulted informant and his family members as a result of which, three persons sustained injuries and during course of treatment, father of the informant died.
4. Learned counsel for the petitioner submits that allegation of assault is general and omnibus. There is no specific accusation of overt act against this petitioner. Similarly situated
Patna High Court CR. MISC. No.82324 of 2025(2) dt.03-12-2025 2/2 co-accused, namely, Sunil Yadav has already been granted regular bail by co-ordinate Bench of this Hon'ble Court vide order dated 14.05.2025 passed in Cr. Misc. No. 16139 of 2025. Petitioner is in custody since 07.07.2025.
5. However, learned A.P.P. for the State as well as learned counsel for the informant vehemently opposed the bail application.
6. Considering the nature of accusation, period of custody and other facts and circumstances of the case, this bail application is allowed. The petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Nalanda at Biharsharif in connection with Noorsarai P. S. Case No. 524 of 2024.
