2. The petitioner apprehends his arrest in a case registered for the offence punishable under Sections 147, 148, 149, 341, 323, 324, 325, 326, 307, 448, 354, 379 and 427 of the Indian Penal Code and Section 27 of the Arms Act.

3. As per prosecution case, this petitioner, along with co-accused Indal Paswan and Amarjeet Paswan, assaulted informant with iron rod and Khanti.

4. It is submitted by learned counsel appearing on behalf of the petitioner that petitioner is innocent and has committed no offence. As a matter of fact, on the alleged date of occurrence, the informant and his team tried to usurp the land of the petitioner's father in which they were unsuccessful and after that they brutally assaulted father of petitioner for which a case bearing Dulhin Bazar P.S. Case No. 109 of 2024 was lodged

Patna High Court CR. MISC. No.85460 of 2024(3) dt.28-01-2025 2/2 against the informant and others and in retaliation this false and concocted case has been lodged. There are general and omnibus allegations and no specific accusation of overt act against this petitioner.

5. Learned A.P.P. for the State has vehemently opposed the prayer for grant of anticipatory bail to the petitioner.

6. Considering the aforesaid facts and circumstances, nature of accusation and case and counter-case between the parties, the prayer for grant of anticipatory bail to the petitioner is allowed.

7. Accordingly, in the event of arrest/surrender within a period of eight weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Danapur, Patna in connection with Dulhin Bazar P.S. Case No. 105 of 2024, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
