2. The petitioner is apprehending his arrest in connection with Jairampur P.S. Case No. 72 of 2025 registered for the offence punishable under Sections 25(1-b)a, 26 of the Arms Act and Section 317(5) of BNS.
3. As per prosecution case, on 13.09.2025 the informant got secret information that co-accused Moti Kumar has brought a blue coloured stolen scooter at his house and has also kept firearm in the house. On the said information, informant along with other police officials reached near the house of co-accused Moti Kumar and saw one person sitting on the blue coloured scooter. It is alleged that on seeing police team, said person managed to escape. Mahal chowkidar
Patna High Court CR. MISC. No.82114 of 2025(2) dt.23-12-2025 2/3 disclosed the name of Moti Kumar, who fled away from the spot. On search, one country made single barrel gun and one number plate, upon which Registration No. BR01FY3938 was mentioned, was recovered from the house of co-accused Moti Kumar. It is further alleged that one blue coloured scooter was also recovered which was parked in front of house of coaccused Moti Kumar.

Learned counsel for the petitioner submits that petitioner is not named in the FIR and during course of investigation, his name has been surfaced upon the confessional statement of co-accused Moti Kumar and Nana Patekar Paswan. Except disclosure of aforesaid co-accused persons, there is nothing on record to connect the present petitioner with the alleged occurrence. He further submits that petitioner has no concern with the aforesaid co-accused. No incriminating article has been recovered from his possession rather allegation has been made against the petitioner without having any substance. He further submits that petitioner is quite innocent and has committed no offence as alleged in the FIR and he has falsely been implicated in this case. Petitioner bears no criminal antecedent.
5. The learned A.P.P. for the State opposes the prayer
Patna High Court CR. MISC. No.82114 of 2025(2) dt.23-12-2025 3/3 for anticipatory bail of the petitioner and submits that during course of investigation, name of petitioner came to fore upon confessional statement of co-accused and hence, he does not deserve anticipatory bail.

Considering the facts and circumstances of the case, keeping in view clean antecedent of the petitioner, argument advanced on behalf of both sides and also taking into consideration the material available on record, the petitioner above-named, in the event of his arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, First Class, Sheikhpura/ concerned court in connection with Jairampur P.S. Case No. 72 of 2025, subject to the conditions as laid down under Section 482(2) of B.N.S.S.
7. The application stands allowed.
