Petitioners seek bail in a case registered for the offences punishable under Sections 307, 341, 342, 323, 324, 325, 504/34 and 302 of the Indian Penal Code and Section 27 of the Arms Act.
Petitioners are in custody since 27.08.2019. Coaccused Samir Yadav allegedly caused fire arm injury at the left arm of the informant and other assaulted with lathi etc. Petitioners are also assailants.
Submission is that subsequently the informant died and the doctor who performed the postmortem did not come to the conclusion regarding cause of death and viscera has been
Patna High Court CR. MISC. No.75861 of 2019(2) dt.28-11-2019 2/2 preserved to ascertain the reason for death.
Considering the general and omnibus nature of allegation against the petitioners, let the above named petitioners be released on bail on furnishing bail bond of Rs.20,000/- (twenty thousand) each with two sureties of the like amount each to the satisfaction of learned CJM, Saharsa in connection with Sour Bazar P.S.Case No.318 of 2019, subject to the condition that both bailors shall be resident of territorial jurisdiction of the learned court below and further the petitioners shall fully cooperate with the investigation of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioners.
