JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 09-06-2020 Heard learned counsel for the petitioners and the learned A.P.P. for the State through video conferencing. The petitioners apprehend their arrest in connection with Ariari P.S. Case no. 136 of 2019 (Excise Case No. 283 of 2019), registered under Section 272 and 273 of the Indian Penal Code and 30(a), 30(D) of the Bihar Prohibition and Excise Act, 2016.
The accusation is of recovery of liquor and apparatus made for preparing country made liquor from the houses of the 16 persons named in the F.I.R, including the petitioners in village-Baikatpur.
Learned counsel for the petitioners submits that it
Patna High Court CR. MISC. No.80906 of 2019(3) dt.09-06-2020 2/2 would appear from the F.I.R. and seizure-list that nothing was recovered from the house of the petitioners and the seizure-list prepared by the informant also shows that country made liquor and apparatus made for preparing the liquor were recovered from filed in village-Baikatpur and not from the house of any persons named in the F.I.R.
Having regard to the facts and circumstances of the case, let the above named petitioners, be released on bail, in the event of their arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Addl. District and Sessions Judge-II, Sheikhpura in connection with Ariari P.S. Case no. 136 of 2019 (Excise Case No. 283 of 2019), subject to the condition as laid down under Section 438 (2) of the Cr.P.C. (Rajendra Kumar Mishra, J) manish/- U T
