JUSTICE VINOD KUMAR SINHA ORAL ORDER 25-11-2019 This application, for grant of anticipatory bail, arises out of Chiraiya P.S. Case No. 171 of 2019, disclosing offences under Section 341, 323 and 498A of the Indian Penal Code and Sections 3/4 of the Dowry Prohibition Act.
Petitioner happens to be husband of the informant and allegation against him is of subjecting the complainant to cruelty in connection with demand of dowry.
Submission of learned counsel for the petitioner is that all the allegations are false and concocted and he is still ready to keep the informant with full honour and dignity and he has taken such stand in the court below also.
Patna High Court CR. MISC. No.75920 of 2019(2) dt.25-11-2019 2/2 Heard learned A.P.P. also.
Having heard both sides, considering the facts and circumstances of the case, this application is disposed of with direction to the petitioner to surrender in the court below within a period of three weeks from the date of receipt of a copy of this order in the court below, on which, the court below shall release the petitioner on provisional bail and call upon the informant of this case and on her appearance, refer the matter to the District Mediation Center, before whom, both the parties have to appear in person and once the report of Mediator is received, learned court below after considering the Mediator's report as well as conduct of the parties shall either confirm the provisional bail of the petitioner or shall pass an appropriate order including cancellation of provisional bail of the petitioner.
