JUSTICE MOHIT KUMAR SHAH ORAL ORDER 25-11-2019 Heard the learned counsel for the petitioners and the learned Additional Public Prosecutor for the State. This is an application for grant of Anticipatory Bail in connection with Complaint Case No. 992 of 2015, registered for the offences punishable under Sections 420, 467 and 120(B) of the Indian Penal Code.

The allegation is regarding the accused persons including the petitioners having manipulated the records of the land of the complainant.

No.76173 of 2019(2) dt.25-11-2019 2/2 The learned counsel for the petitioners has submitted that already a title suit bearing Title Suit No. 590 of 2017 is pending between the parties before the learned Sub Judge-1, Bhagalpur. It is further submitted that the allegation made in the complaint petitioner is only of a civil nature and no criminal case is made out as against the petitioners. The petitioners are stated to be having a clean antecedent.

Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioners, above named, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, on Anticipatory Bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of leaned Additional Chief Judicial Magistrate-XIII, Bhagalpur in connection with Complaint Case No. 992 of 2015, subject to the conditions as laid down under Section 438(2) of the CrPC.
