JUSTICE VINOD KUMAR SINHA ORAL ORDER 06-03-2020 Petitioner seeks bail in connection with Nayagaon P.S. Case No. 117 of 2019, registered for the offences punishable under Sections 397, 307, 414 of the Indian Penal Code and Sections 25(1-B)(a), 27 and 35 of the Arms Act. Petitioner is named in the FIR and as per prosecution case the informant-police official on receiving information regarding firing went to the place of occurrence and saw people were chasing one miscreants and arrested the petitioner, from whom there was recovery of one country-made pistol and empty cartridges of 315 mm and he has also confessed that they have looted a bag from a person containing Rs.60,000/-. Submission of learned counsel for the petitioner is that he is a student and has falsely been implicated and nobody has received injury and further he is in custody for six months.

In view of nature of allegation and he was arrested on chase, at this stage I am not inclined to grant bail to the petitioner.

Accordingly, this application is dismissed.
