Petitioner seeks bail in Kankarbagh P.S. Case No.132 of 2018 registered under Sections 356 and 379 of the IPC. The informant lodged a case that Rs.1,22,759/- was robbed from his possession by unknown persons but during investigation one Amit Kumar Pandey was arrested. Amit Kumar Pandey confessed his guilt and disclosed that the petitioner also conspired. It is further submitted that in para 72 of the case-diary the petitioner had sworn an affidavit that the case was filed by the informant is not true and on account of financial crisis the occurrence took place in collusion with each other. The petitioner is in jail since 05.09.2019. The petitioner has got no criminal antecedent.

It appears that the petitioner being the employee of

No.78993 of 2019(4) dt.28-05-2020 2/2 the Company conspired with other accused persons and lodged a case for robbing Rs.1,22,759/- from his possession but later on it transpired that the petitioner with the help of others lodged a false case in order to grab the amount of the Company but for that the petitioner is in jail since 05.09.2019. The petitioner has already remained in jail for more than eight months and he has got no criminal antecedent.

Having considered the facts aforesaid, the petitioner named above is directed to be released on bail on furnishing bail bond of Rs.10,000/-(rupees ten thousand) with two sureties of like amount each to the satisfaction of learned C.J.M., Patna in connection with Kankarbagh P.S.
