Petitioner seeks bail in Naubatpur P.S.Case No.441 of 2017 registered for the offences under Sections 341, 448, 323, 307/34 of the I.P.C. and Section 27 of the Arms Act. Allegation against the petitioner and other accused persons is of firing on the informant and others. Submission of the learned counsel for the petitioner is that there is land dispute between the parties and allegation of firing is false and concocted and injury report does not support the prosecution story and he is in custody since 13.01.2018. Heard learned A.P.P. also.
Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, be
Patna High Court Cr.Misc. No.47634 of 2018 (4) dt.20-09-2018 2/2 released on bail on furnishing bail bond of Rs.25,000/- with two sureties of the like amount each to the satisfaction of A.C.J.M., II, Danapur, Patna, in Naubatpur P.S. Case No.441 of 2017 subject to the conditions that (1) one of the bailors must be a local person having sufficient immovable property within the jurisdiction of the concerned court. (ii) the petitioner will not induce any witness or tamper with the evidence and the petitioner shall co-operate in disposal of the trial and make himself available as and when required by the court, otherwise, his bail bond shall be cancelled.
