JUSTICE VINOD KUMAR SINHA ORAL ORDER 25-11-2019 This application, for grant of anticipatory bail, arises out of Sasaram (T) P.S. Case No. 116 of 2019, disclosing offences under Sections 406, 420 and 34 of the Indian Penal Code.
Prosecution case is that informant Amit Kumar and other three persons, namely, Saroj Kumar, Markandey Kumar and Rina Devi were doing quiz course, where, they met coaccused Binod Kumar, husband of the petitioner, who told them to provide Govt. job and demanded Rs. Six lakhs each and petitioner also assured them for providing job. On which, informant gave Rs. 5,80,000/-, Saroj Kumar gave Rs. 5,20,000/- and Markandy Kumar gave Rs. 4,60,000 and Rina Devi gave Rs. 2,30,000/- total Rs. 17,90,000/- but the petitioner and her husband has not provided any job to them nor returned the

Submission of learned counsel for the petitioner is that she is a lady and has falsely been implicated in this case and further there is no allegation of inducement and further there is not allegation that she has taken money from the informant and others and she is ready to abide by any condition imposed on her.

Having heard both sides, considering the submission, as above, this application is allowed. Let the petitioner, above named, in the event of her arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sasaram, in connection with Sasaram (T) P.S. Case No. 116 of 2019, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
