2. The petitioner has prayed for regular bail in a case registered for the offence punishable under Sections 341, 323, 504, 498A and 379 of the I.P.C.

3. The case of the prosecution, in short, is that, the complainant was married to the petitioner. It is further alleged that she was subjected to cruelty on account of non-fulfillment of dowry demand of Rs. 40,000/- and one cow.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. It is further submitted that the petitioner neither demanded any dowry nor

Patna High Court CR. MISC. No.83026 of 2025(2) dt.10-12-2025 2/3 tortured the complainant. It is also submitted that the petitione is a laborer. Moreover, the petitioner has clean criminal antecedent and is languishing in judicial custody since 24.06.2025.

Learned counsel for the informant as well as learned APP appearing for the State has vehemently opposed the prayer of regular bail by submitting that from perusal of Annexure-1 it is evident that the provisional bail of this petitioner was granted by a Co-ordinate bench of this Court and was directed to pay Rs. 750/- per month as maintenance which the petitioner did not comply. Further, vide order dated 26.07.2016 passed in Cr. Misc No. 27206 of 2016, he was directed to pay the maintenance amount of Rs. 3000/- as ordered by family Court and was directed to pay the same within four months of release.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Complainant Case No. 754 of 2013 on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st-Class, Araria/concerned trial Court, with condition(s):-
