2. The petitioner is apprehending his arrest in a case registered for the offence punishable under Sections 498A and 307 of the Indian Penal Code.
3. Allegation against the petitioner is that he abused and assaulted the informant and tried to strangulate her with the intention to cause harm to her life.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. Earlier, the informant filed East Champaran Mahila P.S.Case No. 57 of 2022 for the similar nature of offence. No
Patna High Court CR. MISC. No.1581 of 2024(2) dt.08-02-2024 2/2 marriage has been solemnized between the informant and the petitioner. It is further submitted that informant is habitual to lodge a case against the petitioner.
5. Learned APP for the State opposes the prayer for bail.
6. Considering the facts and circumstance of the case, let the above named petitioner in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, be enlarged on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Jhajha P.S. Case No. 271 of 2023 subject to the condition as laid down under Section 438 (2) of the Cr.P.C. (Anjani Kumar Sharan, J) N.K/- U T
