The petitioner is accused in connection with Kawakole (Rupau) P.S. Case No. 35 of 2018, registered under Sections 147, 148, 149, 341, 323, 504, 384 and 379 of the Indian Penal Code and Section 27 of the Arms Act. The accusation is that on 22.02.2018, at 11.30 P.M., informant, Ramesh Kumar, was present at Haldia Dam in connection with loading of soil in the vehicle for filling the ditch near his house. At that time, nine persons named in the FIR including the petitioner, in the police uniform, came there and started to abuse and caused assault to the labourers engaging in loading the soil and also took away the tractor with

Patna High Court CR. MISC. No.76326 of 2019(2) dt.07-01-2020 2/2 driver towards the forest and also snatched the mobile. Thereafter, they demanded ransom on mobile for loading the soil.

Learned counsel for the petitioner submits that petitioner is in custody since 26.08.2019 and similarly situated co-accused, Lakhan Rajbanshi, has already been granted privilege of bail by this Court vide order dated 06.05.2019 passed in Criminal Misc. No. 30016 of 2019.

Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Nawada, in connection with Kawakole (Rupau) P.S. Case No. 35 of 2018. Out of two sureties, one surety must be the close relative of the petitioner.
