2. The petitioners have preferred this application for grant of regular bail in connection with Shambhuganj P.S. Case No. 123 of 2024 dated 03.05.2024 registered for the offence/s punishable u/s 302 read with section 34 of the Indian Penal Code.

3. As per the prosecution case, the petitioners and the co-accused persons are alleged to have assaulted the informant's sister due to that she died during the course of the treatment.

4. Learned counsel for the petitioners has submitted that the petitioners are innocent and have falsely been

There is general and omnibus allegation against the petitioners. The petitioners neither demanded any dowry nor tortured the deceased. The petitioner no. 2 is a lady. The petitioners have clean antecedent as stated in para 3 of the bail petition. The petitioners are in custody since 04.05.2024.

5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioners.

6. Considering the aforesaid facts and circumstances of the case, the petitioner no. 2 namely, Dropadi Devi, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Banka in connection with Shambhuganj P.S. Case No. 123 of 2024.

7. The application for the petitioner no. 2, namely, Dropadi Devi, stands allowed.

8. So far as, the petitioner no. 1, namely, Munna Ram, is concerned, considering the heinous nature of allegation made against him, I am not inclined to enlarge the petitioner no. 1 on bail.
